由于社会不断加快发展,促使民商法形成了民商法文化,其拥有一定的先进性和局限性。先进性主要凸显在社会发展加快和适用技术方面。而目前民商法文化的社会发展加快重点表现在主体和诚信以及权利这些意识方面。并且属于技术文化的一种,主要反映在技术方面。由于时代发展条件的约束,其在展示先进性的过程中,也存在一定的局限性,无法应对大量逐利方法造成的影响。因此,本文进一步探索现代民商法文化先进性和局限性,旨在给其提供一定的参考。
As society continues to accelerate development, prompting the Civil and Commercial Law to form a civil and commercial law culture, it has certain advanced and limited. The advanced nature is mainly highlighted in the acceleration of social development and the application of technology. At present, the acceleration of the social development of the civil and commercial law culture is mainly reflected in the awareness of subject, integrity and rights. Due to the constraints of the development conditions of the times, there are some limitations in displaying the advanced nature and can not cope with the impact of the large number of profit-seeking methods. Therefore, this article further explores the advanced nature and limitations of modern civil and commercial law culture, aiming at providing some references for it.
