在民事诉讼中,原告根据自己利益的需要,在符合法律规定的条件下,可以申请追加被告。但是,在原告没有申请追加被告的情况下,被告是否可以申请追加被告的问题一直没有定论。文章认为,基于诉讼一般理论和司法实践,被告有权申请追加被告,追加后的案件处理方式应分情况而定。
In civil lawsuit, the plaintiff may, in accordance with the needs of his own interests, apply for additional appeals under the conditions prescribed by law. However, there is no conclusion as to whether the defendant can apply for the additional defendant without the plaintiff applying for additional defendants. The article believes that based on the general theory of litigation and judicial practice, the defendant has the right to apply for additional defendants. The case handling after the additional cases should be decided according to circumstances.
