现行宪法颁布实施已经整整十个年头了,回顾十年民主法制建设的轨迹,我们可以清晰地看到作为母法的宪法在其中的历史性作用。十年民主与法制建设的成就验证了当年“新宪法是建国以来最好的一部宪法”的断言。在总结十年来宪法实施的成就和经验的时候,笔者以为,宪法对行政法制的建设和发展,行政法制建设对宪法实施的保障等宪法与行政法制建设的关系问题非常重要。笔者拟就此问题略述浅见。
The current constitution has been promulgated and implemented for exactly ten years. Looking back on the track of the ten-year construction of democracy and the legal system, we can clearly see the historical role of the constitution as the mother law in it. The achievements of the 10-year democracy and legal system construction have proved the assertion that “the new constitution was the best constitution since the founding of our nation”. In summing up the achievement and experience of the constitutional implementation in the past ten years, the author believes that the constitutional issues such as the construction and development of the administrative legal system, the guarantee of the implementation of the administrative legal system for the constitutional implementation and the construction of the administrative legal system are very important. I would like to give a brief account of this problem.
