市场经济体制和社会主义法制建设的大背景下,新型的社会矛盾不断涌现,各种侵害公共利益的案件时有发生,法律尚未能紧随时代的步伐,现实中缺乏可靠的制度保障。因此,被侵害的公共利益往往得不到救济。重建我国的民事公益诉讼制度已势在必行,赋予检察机关公益诉讼权正是构建社会主义和谐社会过程中的司法体制改革的一个方向。
Under the backdrop of the market economy system and the socialist legal system construction, new social contradictions are constantly emerging and various cases of infringement upon the public interest have taken place. The law has not yet followed the pace of the times. In reality, there is a lack of reliable system guarantees. Therefore, the infringed public interest is often not relief. It is imperative to reconstruct our country’s civil public interest litigation system. It is the direction of judicial system reform that the procuratorial organ should give public interest litigation right in the process of building a harmonious socialist society.
