由于医疗纠纷数量的急剧上升 ,缓和紧张的医患关系已成为全社会关注的热点。 1987年国务院颁布的《医疗事故处理办法》已不适应新的形势 ,在新的《办法》不能及时出台的情况下 ,现在急需在旧《办法》的框架内提高医疗鉴定制度的公正性 ,以缓解医疗机构的压力。笔者从鉴定委员会的组成、鉴定的方法、鉴定的依据、鉴定的证据、鉴定的监督等 5个方面提出意见以供参考。
As a result of the sharp rise in the number of medical disputes, it has become a hot issue in the whole society to ease the tense relationship between doctors and patients. In 1987, the “Measures for Handling Medical Accidents” promulgated by the State Council has become unsuitable for the new situation. Under the circumstances that the new “Measures” can not be promulgated in time, it is urgent to improve the fairness of the medical appraisal system within the framework of the old “Measures” Relieve the pressure on medical institutions.
