哈耶克的规则进化命题在秩序图景中存在“个人”与“社会”、相对主义与绝对主义之间的内在分裂或背反,在进化判准上存在功利主义与反功利主义之间的摇摆现象,在动力机制上存在内力论与外力论之间的紧张关系,在进化形式上存在成文与未成文之间的诸多“理性未虑”之问题,在进化结果的定义上存在“进化”与“退化”之间的语义学陷阱。“哈耶克的困惑”启示我们,必须正确对待市场自发力量和国家组织力量在当代中国法治建设中各自的作用及其相互关系。
