比例原则是约束行政裁量权,保障公民权利最有效的手段之一。国家秘密的认定要求定密主体依照保密范围进行判断与裁量,因而存在大量的自由裁量空间,引入比例原则能有效规范定密权的行使,协调国家利益与个人利益的平衡,为政府信息公开与公民知情权提供必要的保障。本文通过阐述在国家秘密认定过程中适用比例原则的重要性,重点分析了比例原则在国家秘密认定中的具体适用以及适用的局限性和存在的问题,并就此提出了相应的对策。
The principle of proportionality is one of the most effective means of restraining administrative discretion and safeguarding citizens’ rights. The determination of state secrets requires that subjects of definite secrecy conduct judgments and discretions according to the scope of secrecy, so there is ample room for discretion. The introduction of the principle of proportionality can effectively regulate the exercise of the right of secrecy, coordinate the balance between state interests and individual interests, Citizens’ right to information provides the necessary guarantees. This article expounds the importance of applying the principle of proportionality in the process of state secrets recognition, analyzes the concrete application of the principle of proportionality in state secrets recognition as well as the applicable limitations and existing problems, and puts forward corresponding countermeasures.
