瑞士国际仲裁立法中的排除协议是一个创新性的规定,充分体现了当事人意思自治和对仲裁的支持,但由于种种原因一直未在实践中得以实施,直到最近几年才出现瑞士联邦法院认可排除协议的迹象。尽管排除了申请撤销裁决的程序,当事人仍然可以在裁决的执行阶段根据《瑞士联邦司法组织法》获得救济。英国等国关于排除协议的规定与瑞士有所不同,当事人在起草排除协议时应予以注意。瑞士关于排除协议的规定体现了当今缩小法院对仲裁进行司法审查范围的趋势,我国可以适时学习和借鉴。
The exclusionary agreement in the Swiss international arbitration legislation is an innovative provision that fully reflects the parties’ autonomy of will and their support for arbitration. However, it has not been implemented in practice for a variety of reasons and until recently the Swiss Federal Court approved the exclusion Agreement sign. Despite the exclusion of the application for the revocation of the award, the parties are still entitled to relief under the Swiss Federal Judicial Organization Act during the enforcement phase of the award. Britain and other countries on the exclusion of the provisions of the agreement and Switzerland are different, the parties in the drafting of the exclusion agreement should be noted. The Swiss rule on the exclusion of agreements reflects the current trend of narrowing the scope of judicial review of arbitration by courts, and our country can learn and draw lessons from it in time.
