“排除合理怀疑”是英美法系刑事诉讼证明标准的标志性表述,它是刑事诉讼中有罪判决的证明标准,也是其最严格的证明标准;该证明标准具有表达形式的主观性、实质追求的客观性以及反证和逆向思维的特点,体现出认识论上的合理性和实践中的可操作性。“排除合理怀疑”可以使我们从全新的视角来考量刑事诉讼之证明标准,对我国诉讼证明的理论探索和实践操作具有重要的借鉴意义。
“Excluding reasonable doubt” is the symbolic expression of criminal procedural proof in Anglo-American legal system. It is the proof standard of criminal conviction in criminal procedure and also the most rigorous proof standard. The standard of proof has the subjectivity of expression form, Objectivity and the characteristics of counter-evidence and reverse thinking, reflecting the rationality of epistemology and the operability in practice. “Excluding reasonable doubt” can make us consider the standard of proof of criminal procedure from a brand new perspective, which is of great reference significance to the theoretical exploration and practice of the proof of litigation in our country.
