正确运用行政处罚程序,是合法地实施消防行政处罚的关键。《行政处罚法》规定,不遵守法定程序的消防行政处罚应视为无效。目前,一些消防监督机构对违反消防法规需要处罚的行为依然沿用以前消防处罚的模式,习惯性地填发消防行政处罚决定书和整改通知书,而没有按照消防处罚的程序履行处罚的职责。《消防法》、《行政处罚法》在行政处罚程序上都作了具体规定,在实施消防行政处罚过程中必须注意以下几个问题:
