我国社会养老保险基金包括个人账户基金和社会统筹基金两部分。公民在社会养老保险基金中的财产性权利主要有三种:个人账户基金的所有权,统筹账户基金的共有权,养老金领取权。通过重塑社会养老保险基金中的公民财产权观念、加强社会养老保险行政程序中的公民参与、运用财产权诉讼等方式,可以更好地保护公民在社会养老保险基金中的财产权。
China’s social pension insurance funds include individual account funds and social pooling funds in two parts. Citizens in the social pension insurance funds in the property rights are mainly three kinds: personal account fund ownership, co-ordination of the account fund’s common rights, pension claims. By reshaping the concept of citizens ’property rights in social pension insurance funds, strengthening citizens’ participation in administrative procedures of social endowment insurance and using property rights litigation, the property rights of citizens in social pension insurance funds can be better protected.
