法律是社会进化的产物,法律解释也不例外。作为生之于社会、长之于社会的法律解释,本身与社会须臾不可分离。社会是法律解释所依赖的基础,与此同时法律解释具有影响社会的功能。法律解释的社会功能主要有两项:一是社会化,另一是秩序维持。关于法律解释的社会化功能,社会连带关系理论和社会系统理论有不同的理解。至于法律解释的秩序维持功能,则有阶级统治、合理化和社会控制这三种理解。法律解释通过这些社会功能,不断地影响社会,并推动着人类社会的发展。
Law is the product of social evolution, legal interpretation is no exception. Being born in the community and extended to society, the legal interpretation itself is inseparable from society. Society is the basis on which legal interpretation depends, and at the same time, legal interpretation has the function of influencing society. There are two main social functions of legal interpretation: one is socialization and the other is order maintenance. There are different understandings of the social function of legal interpretation, the social and social relations theory and the social system theory. As for the order maintenance function of legal explanation, there are three kinds of understanding: class rule, rationalization and social control. Legal interpretation through these social functions, continue to influence society and promote the development of human society.
