体系结构的设计是国际私法典制定的基础。现有国际私法典主要采取总则、分则和附则的结构。由于对国际私法范围、性质等问题认识不一,各国在具体内容的编排上又各有特色。我国国际私法典体系结构的设计必须遵循系统化和实用化原则,采用两编制,即设法律适用和国际民事诉讼两编,并另设序言和附则。
The design of the architecture is the foundation of the international private code. The existing international private code mainly adopts the general rules, sub-rules and the structure of by-laws. Due to the different understanding of the scope and nature of private international law, each country has its own characteristics in the arrangement of specific contents. The design of the structure of China’s private international private code must follow the principle of systematization and practicality. The two systems should be adopted, namely the application of law and international civil litigation, and a separate preamble and by-laws.
