我国在实现社会主义法治国家与社会主义和谐社会建构取得一定成绩的同时,部分党和国家领导干部以及工作人员公权私用、知法犯法、以权压法、贪赃枉法现象较为突出,损害人民群众的利益,甚至危及党的执政之基和国家的稳定。公权力的规范与限制是当前我国学界、政界讨论的焦点,是解决社会矛盾主要路径之一。洛克的权力理论对近代民主政治的产生和发展有着重要的意义,对我国的社会主义法治建设也具有一定的推进功能。通过对英国著名自然法学家洛克权力理论的解读,发掘其社会契约、公众福利和法律至上思想,这对于我国社会主义法治国家的建设以及国家的和平稳定有着很好的启示意义。

Through the interpretation of Locke ’s theory of power of the famous British natural law scientist, exploring its social contract, public welfare and legal supremacy thoughts, this has very good enlightenment significance for the construction of our socialist country ruled by law and the country’ s peace and stability.
