将实践教学融入理论课程,有助于法学专业课程在有限的课时、资源的限度内提升学生的应用能力,从而实现应用型职业法律人才的培养目标。在理论课程中融入实践教学,需要以“培养法律思维方式”和“提高法律应用能力”为教学目标,并结合所在院校专业目标对课程的要求,将“应用型人才”与“应用能力”具体化。实践教学包括课堂实践教学与课外实践教学,课堂实践教学以案例教学法为主,着重于学生口头表达能力与不同法律职业思维的训练;课外实践教学分为面向全体学生的课外学习——以训练写作和思维能力为目标,以及个性化的课外学习——以训练学生研究新问题的能力为目标。实践教学融入理论课程,还需要建立学习过程考核机制,并且以应用能力为考核目标。
