本刊2003年第5期《疑案会审》栏刊登了《瞿某是收受礼品礼金还是贪污公款》的案例后,各地读者纷纷来信参与讨论,提出了各自的看法,大体分两种:一、认为瞿某的行为已构成违纪,应认定为贪污公款。持这种观点的同志有:江苏省无锡质量技术监督局施增熙,江苏省沛县纪委审理室,山西省左云县纪委、监委审理室,河北省唐山市路南区纪委审理室,湖南省怀化市纪委张念英,湖南省沅江市纪委杨战鸿,内蒙古自治区奈曼旗纪委李兴民,新疆维吾尔自治区昭苏县纪委吴祺龙,贵州省织金县纪委高讽等。二、认为瞿某的行为已构成违纪,应认定为非法占有错误。持这种观点的同志有:山西省纪委、监委赵炜,广东省惠来县纪委林泽宏等。因篇幅所限,其他读者来信的观点和姓名本刊不再一一刊登。究竟瞿某的行为应如何定性,这里特刊发本刊顾问组的意见,作为该案讨论的结论,供读者参考。———编者
This issue of 2003 No. 5 “suspect case trial” column published “Qu is a gift of money or embezzlement of public funds,” the case, all over the letter from the readers involved in the discussion, put forward their own views, generally divided into two types: First, that Qu behavior has constituted a violation of discipline, should be identified as embezzlement of public funds. Comrades holding this view are: Jiangsu Wuxi Quality and Technical Supervision Shi Zengxi, Pei County Commission for Discipline Inspection in Jiangsu Province, Zuo Yunxian County Commission for Discipline Inspection, Jurisdiction Unit, Tangshan City, Hebei Province Commission for Discipline Inspection, Hunan Province Zhang Naiying, Discipline Committee of Huaihua City, Yang Zhanhong, Commission for Discipline Inspection of Yuanjiang City, Hunan Province, Li Xingmin, Commission for Discipline Inspection of Naiman Banner, Inner Mongolia Autonomous Region, Wu Qi Long, Commission for Discipline Inspection of Zhaosu County, Xinjiang Uygur Autonomous Region, and Gao Rongxi, Discipline Committee of Zhijin County, Guizhou Province. Second, that the acts of Qu has constituted a violation of discipline, should be identified as illegal possession of errors. Comrades holding this view are: Shanxi Provincial Commission for Discipline Inspection, Supervision Committee Zhao Wei, Guangdong Province Huilai County Commission for Discipline Inspection Lin Zehong and so on. Due to space constraints, the views of other readers and name of the article is no longer published one by one. Qu how the behavior of what should be qualitative, this special issue of the views of the Advisory Group, as the case of the conclusions of the discussion for the reader’s reference. ---editor
