在刑事侦查过程中,获取犯罪嫌疑人的真实口供不仅是案件顺利侦办的重要保障,而且为侦查机关全面准确查明案件事实奠定基础。随着修正后《刑事诉讼法》对于犯罪嫌疑人权利的不断强化以及对侦查权的限制,如何依法、有效突破犯罪嫌疑人口供再一次成为关注的焦点。笔者认为,侦查人员必须认真思索这一问题,不断总结实践经验,既能够谙熟各种讯问策略,又可以科学运用讯问语言,并敢于与犯罪嫌疑人建立良性互动关系,通过切实提高讯问水平,充分适应修正后《刑事诉讼法》的要求。
In the process of criminal investigation, obtaining the true confession of criminal suspects is not only an important safeguard for the smooth investigation and handling of cases, but also provides the basis for investigating organs to fully and accurately ascertain the facts of the case. With the amended “Criminal Procedure Law” for the continuous strengthening of the rights of suspects and the restriction on the investigative powers, how to effectively break through the suspect’s mouth according to law has once again become the focus of attention. The author believes that investigators must seriously consider this issue and constantly sum up practical experience, both familiar with a variety of interrogation strategies, but also the scientific use of interrogation language, and courage to establish a benign interaction with the suspect by effectively raising the level of interrogation, full Adapt to the amended “Code of Criminal Procedure” requirements.
