我国正处于社会转型时期,城镇化进程速度较快,在这一发展过程中必然会面临农地征收问题,如何确保农民在土地征收过程中的权利依法得到保护,是值得我们思考的问题。中共中央召开的第十八届全国人民代表大会,政府报告指出:让农民得到更多土地增值收入。由此可见,国家对加强保护农民在征地中的权利予以高度重视。本文着重于对土地征收中农民权利保护问题进行探讨,通过借鉴域外的相关立法,选择适合我国国情的内容,从而完善土地征收中农民权利的保护制度。
Our country is in the period of social transformation. The process of urbanization is fast. In this process of development, we will inevitably face the issue of farmland collection. How to ensure that the rights of peasants in the process of land expropriation are protected in accordance with the law is something that we should think about. The 18th National People’s Congress held by the CPC Central Committee and the government report pointed out: To allow farmers more land appreciation income. Thus, the state attaches great importance to strengthening the protection of peasants’ rights in land acquisition. This article focuses on the protection of peasants ’rights in the process of expropriation of land and discusses the protection of peasants’ rights in land expropriation through drawing lessons from the relevant legislation outside the territory and choosing the appropriate content for our national conditions.
