涉诉信访制度是广大人民群众权利救济、民主监督和民意表达的重要途径。然而,当前涉诉信访制度以人治为主导思想的逆法治救济本质等问题产生的负面效应正在逐渐增大,严重影响了司法权威和独立,不利于法治国家的建设。改革和完善涉诉信访制度应从涉诉信访预防机制着手,以重塑司法权威和降低信访人心理预期。与此同时,要构建涉诉信访化解机制,建立涉诉信访听证制度,严格责任追究制度,完善权利救济渠道,切实保障公民合法权益。
The system of letters and visits involving petitions is an important way for the masses to rescue their rights, monitor democracy and express their opinions. However, the negative effects arising from the current anti-statutory remedy essence such as the principle of people’s rule are gradually increasing, seriously affecting the judicial authority and independence and not conducive to the construction of a country under the rule of law. Reform and improvement of petition system should involve letters and visits from the prevention mechanism to reshape the judicial authority and reduce the psychological expectations of petitioners. At the same time, it is necessary to set up a mechanism for settling letters and visits involving complaints, establishing a system of hearing letters and visits involving complaints, strict accountability system, improving the channels for remedying rights and earnestly protecting the legitimate rights and interests of citizens.
