河南省是人口大省,更是农业大省。农业利用外资是河南利用外资工作的重要方面。良好的法治软环境不仅能够建立外来投资者的信心,也是政府在对外资企业行使监督管理权时有法有据,更是为河南农业的长远发展提供充分有效的法制保障。本文在对河南农业利用外资的数据进行纵向分析和横向分析的基础上,发现法治软环境是影响河南农业利用外资效率的重要因素。美国、巴西、印度这些国家农业利用外资的实践同样揭示了良好的法治环境对农业利用外资的重要影响。文章在对河南农业利用外资的立法、行政执法及司法环境存在问题进行分析的基础上,提出完善河南农业利用外资法治软环境的具体对策,希望对河南农业利用外资工作的推进,法治软环境的构建与完善有所助益。
Henan Province is a large population, it is a big agricultural province. The use of foreign capital in agriculture is an important aspect of Henan’s utilization of foreign investment. A good legal soft environment can not only establish the confidence of foreign investors, but also provide a legal basis for the government to exercise the power of supervision over foreign-funded enterprises, and provide adequate and effective legal protection for the long-term development of Henan agriculture. Based on the longitudinal analysis and horizontal analysis of the data of Henan’s agricultural utilization of foreign capital, this paper finds that the soft environment of the rule of law is an important factor that affects the efficiency of Henan’s agricultural utilization of foreign capital. The practice of using foreign capital in agriculture in the United States, Brazil and India also revealed the important influence of the good rule of law environment on the utilization of foreign capital in agriculture. Based on the analysis of the existing problems about the legislation, administrative law enforcement and judicial environment of agricultural utilization of foreign capital in Henan, the article puts forward the concrete countermeasures of perfecting Henan agriculture ’s soft environment of utilizing foreign investment by law, hoping to promote the construction of Henan soft agriculture, Improve the useful.
