小产权房的合法性与合理性问题,小产权房的法律定义和法律的归属性问题,以及能否用现行法律适用到小产权房的问题。一方面小产权房的热销和另一方面小产权房的属性与现行法律政策的冲突,使其成为当下政府急迫需要解决的与民生息息相关的重大问题。但是小产权房问题并不是单一的法律,其政策性政治性和普遍性使其面成为复杂的社会问题。我们可以选择法律和政治政策相结合的手段,平稳的解决。
The legitimacy and rationality of small property room, the legal definition of small property room and the attribution of law, as well as the question of whether it can be applied to the small property room with the existing law. On the one hand, the hot selling of small property houses and the conflict between the property rights of small property houses and the existing laws and policies on the other hand make it a major issue that the current government urgently needs to solve and is closely linked with people’s livelihood. However, the issue of small property is not a single law, and its policy politics and universality make it a complex social issue. We can choose a combination of legal and political policies that can be smoothly resolved.
