“万物并育而不相害,道并行而不相悖”。规范二元论的古典结构具有天理人情的巨大理念与制度张力,“礼法结合”、“礼法相济”的互尊与互补结构对平和国家法制主义与民间社会活力之间的矛盾具有特殊的国情与文明意义。个案公正的期许与法治中国的构建共同指向了尊重民间习惯进而在理念与制度层面破旧立新的改革冲动,而规范二元的路径不失为一种解题的可能。
