法治社会语境下的社会法,应当是涵盖典型社会法和“社会性法”的广义社会法体系。它在我国法治社会建设中具有不可替代的工具价值,包括改善基本民生、实现社会公平、推动社会管理创新、引导公民遵纪守法以及促进经济增长方式转变等重大方面。同时,必须认清,社会法在中国特色社会主义法律体系中属于后进之学、势微之法,于立法、执法、司法救济等环节都存有弊端,必须认真反思,努力重构,否则将阻碍其自身在法治社会建设中发挥应有的功能。
The social law under the rule of law society should be a system of generalized social law covering typical social law and “social law ”. It plays an irreplaceable tool value in the construction of rule of law in our country. It includes such important aspects as improving basic livelihood, achieving social fairness, promoting innovation in social management, guiding citizens to abide by the law and promoting the transformation of economic growth mode. At the same time, we must recognize clearly that social law belongs to the backward learning method and the weak law in the socialist legal system with Chinese characteristics. It has drawbacks in the legislative, law enforcement and judicial remedies. We must seriously reflect on it and work hard to reconstruct it. Otherwise, Hindering itself from playing its due function in the construction of a society ruled by law.
