全国五大自治区自治条例的制定都陷入了困境,以宁夏回族自治区为例考察,自治条例制定陷入困境的原因首先是制定者认识不统一,在几乎所有相关问题上都未能形成正确的共识,对自治条例的法性质也未有正确的认识;第二是立法技术问题;第三是全国的大环境事实上一直不稳定。相应的对策有:对自治条例的重要性、法性质和内容要有正确的认识;对相关问题要形成共识;要按照正确的制定路径制定自治条例,须国家最高立法机关和最高国家行政机关与各个自治区立法机构通力协作才能制定出自治区级自治条例。
The formulation of self-government ordinances in the five major autonomous regions in China is in a dilemma. Taking Ningxia Hui Autonomous Region as an example, the reason for making the self-government ordinance into trouble lies in the fact that the formulators are not unified in understanding and can not form a correct consensus on almost all relevant issues. The law nature of the autonomy ordinance does not have a correct understanding either. The second is the technical issue of legislation. The third is that the nation’s environment has in fact always been unstable. Corresponding countermeasures include: the importance of the autonomous regulations, the nature and content of the law should have a correct understanding of the relevant issues to be formed consensus; in accordance with the correct formulation of the development of autonomous regulations, the highest state legislature and the highest state administrative organs and Autonomous regions legislatures work together to develop autonomous-level autonomous regulations.
