对于民商法而言,连带责任的认定是一个非常关键的问题,在处理民事纠纷以及责任判定等方面意义重大。但是从目前来看,在民商法中,关于连带责任及相应的限制性规定不够规范,存在一定的模糊性,影响了功能的充分发挥。本文从连带责任的概念出发,对民商法中存在的连带责任认定问题进行了分析,并提出了有效的解决措施。
As for civil and commercial law, the joint and several liability is a very crucial issue, which is of great significance in dealing with civil disputes and determination of liability. However, for now, in the Civil and Commercial Laws, there is a certain degree of ambiguity about the joint and several liability and the corresponding restrictive provisions, which have affected the full development of functions. Based on the concept of joint and several liability, this article analyzes the existing problems of joint and several liability in civil and commercial law and puts forward effective solutions.
