当前办案质量存在的主要问题从安徽省的情况来看,执法办案主要存在以下问题:案件批捕率低 1999年全省平均批捕率为87％,2000年1～5月份为84％。这表明,还有15％左右的人,应当受到刑罚处罚的却没有得到处罚(这还不包括刑拘后有相当一部分人没有报捕)。这些人究竟到哪里去了?只有两种可能,一种可能是当时只是嫌疑,不构成犯罪;另一种可能就是因各种原因在公安民警手中把人放了。1998、1999两年,全省检察机关共纠正漏捕907人。为什么会出现这种情况?办案质量不高是其中的一条重要原因。
