刑事附带民事诉讼中的精神损害赔偿制度的出现和不断完善表明了社会文明的发展已经达到一个崭新的程度。受害人因其人身权利受到侵害而要求侵权人通过财产赔偿方式进行救济的法律赔偿制度已得到世界各国的普遍认同。目前我国刑事附带民事诉讼中的精神损害赔偿制度仍存在缺陷,需要结合我国的司法实践构建具有中国特色的刑事附带民事诉讼精神损害赔偿制度,这样才能进一步贯彻依法治国的指导思想,有效地制止侵权行为,充分保护当事人的人格权益。
The emergence and continuous improvement of the system of compensation for mental damages in criminal incidental civil proceedings shows that the development of social civilization has reached a completely new level. The system of legal compensation for victims’ infringement upon their personal rights that require the infringer to provide relief through property compensation has been universally accepted by all countries in the world. At present, there is still a flaw in the system of compensation for moral damages in criminal incidental civil action in our country. Therefore, it is necessary to construct a system of moral damages for criminal suit-by-incident with Chinese characteristics in light of the judicial practice in China so as to further implement the guiding principle of governing the country according to law so as to effectively stop the infringement Behavior, fully protect the personality rights of the parties.
