2012年4月6日正式生效的《政府采购协定》新文本纳入了反腐败的规定,意味着GPA第一次把政府采购中的反腐败明确规定为成员方的义务。我国虽然还没有正式加入GPA,但是这一新规定对中国依然影响重大。本文第一部分概括介绍了政府采购与国际政府采购市场的现状,分析了GPA在政府采购开放中发挥的重要而独特的意义。第二部分介绍政府采购中的腐败问题。第三部分总结了GPA新文本中的反腐规定,明确了成员方由此而需要承担的义务。第四部分分析了新文本反腐规定可能给中国带来的影响,并进而有针对性地提出中国的应对策略。
The new text of the GPA, which came into effect on April 6, 2012, incorporates anti-corruption provisions, implying that for the first time, the GPA clearly sets anti-corruption in government procurement as a member’s obligation. Although China has not formally joined the GPA yet, this new regulation will still have a huge impact on China. The first part of this article gives an overview of the current situation of government procurement and international government procurement market, and analyzes the important and unique significance of GPA in the government procurement opening up. The second part introduces the issue of corruption in government procurement. The third part summarizes the anti-corruption provisions in the new GPA text and clarifies the obligations that members need to shoulder. The fourth part analyzes the possible impact of the anti-corruption regulations in the new text on China, and then proposes China’s response strategies in a targeted manner.
