人民调解制度在我国有着深厚的文化根基和时代需求。通过对各国调解制度的分析与比较,有利于我们借鉴各国的成功经验,从而更好地建构我国的人民调解制度。人民调解制度需要从加强立法,规范调解行为;建立专业的人民调解员队伍;完善审前准备程序,实行调解前置;妥善解决调解协议的效力问题的预警去完善。
People’s mediation system in our country has a profound cultural foundation and the needs of the times. Through the analysis and comparison of the mediation systems in various countries, it is good for us to learn from the successful experiences of all countries so as to better construct the people’s mediation system in our country. The people’s mediation system needs to strengthen legislation and regulate mediation; establish a professional people’s mediator team; perfect the pre-trial preparation procedure and implement the precondition of mediation; and properly resolve the warning of the effectiveness of the mediation agreement.
