新律师法明确规定律师是为当事人提供法律服务的执业人员和律师可以个人开办律师事务所;对长期困扰律师的会见难、阅卷难、取证难等问题做出了前瞻性、保障性规定;对律师、警察、法官、检察官都提出了新的更多的要求。但是,刑诉法等程序法中的现有规定,制约着新律师法的贯彻实施,必须抓紧修订,配套协调。
The new law clearly stipulates that lawyers are practitioners and lawyers who provide legal services to clients and may start law firms on a personal basis. They make forward-looking and safeguarding provisions on issues such as difficulty in meeting witnesses, difficulty in reading papers, and evidence gathering that have long plagued lawyers. Lawyers, police, judges, and prosecutors have all made new and more demanding demands. However, the existing provisions in the procedural law such as the Criminal Procedure Law restrict the implementation of the new Law on Solicitors, and we must pay close attention to revision and supporting coordination.
