提交书面意见在国际仲裁中是一项具有特殊挑战性的任务。本篇短文借鉴古人的智慧并对如何提高国际仲裁书面意见的说服力提出十个实用意见。ICC国际仲裁法院的总部位于巴黎,在其建设过程中出土了一个被埋在数箱已经石化的仲裁文书和证据下的石碑。一队考古专家历时数月对石碑上的文字进行破译,进而充分掌握了石碑上文字内容的含义,并传递出了其对当今国际仲裁从业者的重要启示。本文将再现石碑上的文字,并附加作者的注释。
Submitting written comments is a particularly challenging task in international arbitration. This essay draws on the wisdom of the ancients and presents ten practical opinions on how to improve the persuasiveness of written opinions on international arbitration. ICC International Court of Arbitration is headquartered in Paris and during its construction a stone tablet buried under a few boxes of petrified arbitration documents and evidence was unearthed. A team of archaeologists took several months to decipher the text on the stone tablet to fully grasp the meaning of the text on the stone tablet and conveyed its important implications for today’s international arbitration practitioners. This article will reproduce the text on the stone, with the author’s notes.
