污染环境罪中的主观故意包括对犯罪构成要件的认识和意志,前者主要涉及对环境污染行为具有违法性、污染物和污染行为的认识,后者是在确证行为人排放、倾倒或处置污染物的情况下,可以直接认定具有主观故意,但允许行为人进行反证。在认定犯罪既遂方面,涉及对排放、倾倒、处置污染物行为的认定、危害后果的认定。污染环境罪的共犯主要涉及单位内部的共犯认定和上下游犯罪的共犯认定。
