现在,我国广大企业,特别是广大外贸生产经营企业,都在采取积极举措,迎接加入WTO后的新挑战。然而,有一项工作,却还未引起有关方面的应有重视,那就是企业标准体系的制定。说来,标准体系的制定,对于企业在WTO框架下依法开展生产经营,保护自己的合法权益不受侵犯,是不可或缺并相当重要的。WFO有一批关于非关税壁垒的多边协议与诸边协议,如《对贸易的技术性壁垒协议》、《关于卫生和动植物检疫的协议》、《海关估价协议》等。这些协议中的许多条款,都对相关标准给予了合法的地位。《对贸易的技术性壁垒协议》承认,各国在其认为适当的程度内有权采取此类措施。例如,为了人类、动物、植物的生命或健康,为了环境保护或为了满足消费者的其他利益而采取此类措施。协议鼓励各国采取那些合适的国际标准,但并不要求他们因为标准化而改变其保护水平,
Now, the vast majority of enterprises in our country, especially the vast number of foreign trade production and operation enterprises, are taking active measures to meet the new challenges after China’s entry into the WTO. However, one work has not yet drawn the attention of the parties concerned, that is, the establishment of an enterprise standard system. To put it in practice, the formulation of a standard system is indispensable and of great importance to enterprises that conduct their production and operation in accordance with the law within the WTO framework and protect their legitimate rights and interests. WFO has a number of multilateral agreements on non-tariff barriers and plurilateral agreements such as “Agreement on Technical Barriers to Trade”, “Agreement on Sanitary and Fauna Quarantine”, “Customs Valuation Agreement” and so on. Many of these agreements give legitimacy to relevant standards. The Agreement on Technical Barriers to Trade recognizes that States have the right to take such measures to the extent they consider appropriate. For example, such measures are taken for the protection of human beings, animals, plants or their life or health, for the protection of the environment or for the satisfaction of other interests of consumers. The agreement encourages countries to adopt those appropriate international standards but does not require them to change their level of protection because of standardization,
