美国的劳动争议仲裁体制是根据劳动争议的特性而建构的新型ADR,并分为权利仲裁和利益仲裁。权利仲裁属于自愿仲裁,包括怨情申诉程序和仲裁程序。利益争议事项涉及劳资双方的未来利益,仲裁往往是为促成劳资双方的集体协商。为保障仲裁的公正性,美国法院通过多个判例构成了仲裁裁决的司法审查制度。我国劳动争议仲裁体制应正视劳动关系的特殊性,建立体现劳动仲裁特性的仲裁体制。
The labor dispute arbitration system in the United States is a new type of ADR constructed according to the characteristics of labor disputes. It is divided into rights arbitration and benefit arbitration. Arbitration of rights is voluntary arbitration, including grievance appeals and arbitration proceedings. Interests disputes involve the future interests of both employers and employees. Arbitration is often intended to facilitate collective bargaining between employers and employees. In order to ensure the fairness of arbitration, the U.S. courts formed a system of judicial review of arbitral awards through multiple precedents. The labor dispute arbitration system in our country should face the particularity of labor relations and set up an arbitration system that reflects the characteristics of labor arbitration.
