随着社会的不断发展,依法治国的不断推进,法治思想不断深入人心,越来越多的人知法、守法、用法,但同时一些人利用法律的空白和不完善虚构法律关系、恶意串通,合谋编造虚假事实和证据进行虚假诉讼,以便实现其非法目的,损害其他利益相关人的合法权益。基于此本文对虚假诉讼现状和原因进行分析,结合实务和现今法律发展的趋势提出解决建议,以期能够更好解决对以后虚假诉讼。
With the continuous development of society, the rule of law has been continuously promoted. The thought of the rule of law has been deeply rooted in the hearts of the people. More and more people know the law, abide by the law and use it. However, at the same time, some people make use of the legal gaps and imperfections in fictitious legal relationships, Fabricate false facts and evidence to carry out false litigation in order to realize their illegal purposes and undermine the legitimate rights and interests of other stakeholders. Based on this analysis of the status quo and the reasons for the fake lawsuit, combined with the practice and the trend of the development of the law today proposed solutions to the problem, with a view to better resolve the future of false litigation.
