最近发生在西安的“绿领巾”事件引起了社会的广泛关注,这种在老师看来是教育激励手段的事件在本质上则严重地侵犯了学生的受教育平等权。通过对受教育权和受教育平等权的内涵进行阐述,以及对我国受教育权不平等的现状进行分析,从而对教育不平等问题的解决提供一种宪法思路。
The recent “Green Scarf” incident in Xi’an has aroused widespread concern in the community. This kind of incident, which the teacher appears to be a means of education and encouragement, is in essence a serious violation of the students’ right to education. By expounding the connotation of the right to education and the equal right to education, and analyzing the current situation of the inequality of the right to education in our country, we can provide a kind of constitutional thinking on the solution to the educational inequality.
