统计违法案件的频繁发生为我国统计立法的完善工作提出了新的要求。完善的重点应从立法渊源转向立法适用,统计法律责任问题是困扰我国统计立法可适用性的痼疾。惩罚性法律责任是保障立法可适用性的有效手段。通过立法文本的修改而完善我国惩罚性统计法律责任是非常有必要的,也是可行的。
The frequent occurrence of cases of illegal statistics put forward new requirements for the improvement of China’s statistical legislation. The perfect focus should be shifted from the source of legislation to the application of legislation. The issue of statistical legal liability is a chronic illness that plagued the applicability of our statistical legislation. Punitive legal responsibility is an effective measure to guarantee the applicability of legislation. It is very necessary and feasible to improve the legal responsibility of punitive statistics in our country through the revision of the legislative texts.
