根据《动物防疫法》规定,各级动物卫生监督所主要承担动物检疫、动物卫生监督等行政执法工作。但在实际工作中,许多的执法机构受兽医主管部门的委托还从事畜禽标识违法处罚,兽药、饲料流通环节监管等行政执法工作。由于忽视了行政执法委托的程序,在行政委托中出现了一些不规范的现象,为规范执法留下了很大隐患。本文分析了委托执法存在的问题,提出了具体的解决办法。
According to the provisions of the Animal Epidemic Prevention Law, the animal health supervision agencies at various levels mainly undertake the administrative law enforcement work such as animal quarantine and animal health supervision. However, in actual work, many law enforcement agencies are also entrusted by the competent veterinary department to carry out administrative punishments such as illegal handling of livestock and poultry signs, supervision and administration of veterinary drugs and feed circulation. Due to the neglect of the procedure of administrative law enforcement commission, some non-standard phenomena appeared in the administrative entrustment, leaving a great deal of hidden dangers for standardizing law enforcement. This article analyzes the problems existing in entrusted law enforcement and puts forward specific solutions.
