高校与学生关系的定位是高校学生管理工作的理论基础。随着现代社会法治进程的推进,要求高校与学生关系的定位不能仅从人才培养的教育角度考虑,还必须从保障合法权益的法律角度考虑。由于军校学员自入伍起就取得军籍,他们既是大学生,也是军人,其身份的特殊性决定了军校学员与军校的法律关系更多地参照军人身份的法律关系。
The relationship between college and students is the theoretical basis for the management of college students. With the promotion of the rule of law in modern society, it is required that the orientation of the relationship between universities and students not be considered solely from the educational point of view of personnel training, and must also be considered from the legal point of view of safeguarding legitimate rights and interests. Since military cadets obtained military service since they were enlisted, they are both college students and military personnel. The particularity of their status determines that the legal relationship between cadets and military academies refers more to the legal relationship of military status.
