法官的中立、公平正义,是法官伦理的组成部分,一般只是将其视为法官的素质和修养本身。法官把法律应用到每个具体案件时,法官是一个法律的提供者,而当事人则是一个法律接受者。法律的语言是神秘的和难懂的,为了推进可信赖的民事诉讼的进程,达到当事人的合理预期,应当突出法官专业伦理的责任,以法官诉讼行为的合法性、规范性为基础,通过法官与诉讼当事人之间的倾听、沟通、互动来实现正义的裁判结果。透过法官专业伦理,才更能够体现民事诉讼的灵魂,其诉讼结果才是值得信赖的。这也是司法公信力和司法权成的基础。
The judge’s impartiality, fairness and justice are part and parcel of the judge’s ethics. Generally, judges are regarded as judges’ qualities and self-cultivation. When a judge applies the law to each specific case, the judge is the provider of the law and the client is the recipient of the law. The language of law is mysterious and incomprehensible. In order to advance the process of credible civil litigation and achieve the reasonable expectation of the parties, it is necessary to highlight the responsibility of professional ethics of judges and to pass judges’ legitimacy and normativity based on the legal actions of judges Listening, communicating and interacting with litigant parties to achieve the result of refereeing justice. Only through professional ethics of judges can we better reflect the soul of civil litigation and the result of its litigation is trustworthy. This is also the basis for judicial credibility and judicial power.
