在提倡民主与法治的当今社会,公权的规范运行是应有之义。但由于我国仍处在社会转型期,内部存在法制建设缓慢、人民内部利益分配不均和熟人社会背景下的权钱交易严重等问题,造成了公权与私权关系的冲突。本文在分析现阶段公权力运行现状及问题基础之上,提出了规范其运行的路径选择。
In today’s society that advocates democracy and the rule of law, the normal operation of public power is due. However, due to the fact that our country is still in a period of social transition, there are some problems such as the slow internal development of the legal system, the uneven distribution of benefits among the people, and the heavy trading of power and money in the acquaintances’ social context. This has resulted in the conflict between public rights and private rights. Based on the analysis of the present situation and problems of public power operation, this paper puts forward the route to regulate its operation.
