随着交通部、国家发展和改革委员会、国家工商行政管理总局于2006年4月18日联合公布THC问题的调查结论,在我国长期存在的THC问题的争论获得了较圆满的解决。为了将来避免类似问题发生后能够得到快速和有效的解决,本文总结了在我国THC问题产生的背景、争议的焦点,认为在我国THC问题的产生和解决的困境主要是我国国际航运市场竞争规则的缺失。作者在对调查结论进行分析的基础上,结合国际社会解决THC问题的经验,对完善我国国际航运市场竞争规则提出了设想。
With the Ministry of Communications, the National Development and Reform Commission and the State Administration for Industry and Commerce jointly promulgating the findings of the THC on April 18, 2006, the controversy over the long-standing issue of THC in our country has been satisfactorily resolved. In order to prevent similar problems from happening quickly and effectively in the future, this paper summarizes the background and controversial issues of THC in China, and concludes that the predicament of THC in our country is mainly the competition rules in the international shipping market Missing. Based on the analysis of the investigation conclusion and the experience of the international community in solving the THC problem, the author puts forward some ideas to improve the competition rules of China’s international shipping market.
