我国的外资立法中存在以下主要问题:①国内法方面:立法缺乏系统性和透明度;自然人不能作为中方投资主体;②国际法方面:在国民待遇问题上态度过于审慎,国际条约的某些规定对我国不利。
The following are the main problems in our country’s foreign investment legislation: (1) In domestic law, the legislation lacks systematicness and transparency; natural persons can not serve as the main body of Chinese investment; (2) In the aspect of international law: the attitude on national treatment is too cautious; some provisions of international treaties unfavorable.
