清末司法体制改革失败的原因错综复杂,不仅有表面原因,如经费缺乏、人才稀缺、传统习惯的影响、法令不完备、外国列强治外法权的干涉、行政干预司法审判的运行等,而且有深层次原因如缺乏真正实现司法制度改革的经济条件—较为发达的商品经济、缺乏真正实现司法制度改革的民主政治条件、缺乏与司法独立司法制度相适应的思想价值理念等,更主要的是深层次原因
