虽然我国入世文件中对“跨境交付”方式下教育服务国民待遇未作承诺 ,但与各种教育服务有关的国民待遇问题仍值得关注。本文论述了WTO《服务贸易总协定》关于服务贸易的特定国民待遇原则也适用于这种教育服务的观点 ;并认为WTO成员可以通过教育服务部门经济一体化、承认等方式有选择地给予“跨境交付”方式下的教育服务以国民待遇 ,以扩大教育服务国际合作。
Although China’s accession document does not make any commitment to the national treatment of education services under the “cross-border delivery” approach, the issue of national treatment relating to all kinds of education services still deserves our attention. This article discusses the WTO GATS principles of service-specific trade-specific national treatment is also applicable to this point of view of education services; and that members of the WTO through educational services sector economic integration, recognition, etc. selectively given “cross Border delivery ”mode of education services to the national treatment in order to expand international cooperation in education services.
