从我国的司法实践来看,保护消费者权益、处理消费者与经营者之间的争议和纠纷等民事问题在《消费者权益保护法》未出台之前,主要是根据《民法通则》行事的。与《民法通则》比较,《消费者权益保护法》进一步确立了消费者的权利、经营者的义务以及二者在交易活动中应遵守的原则,特别是侵犯消费者权益后应承担的民事责任,从而弥补了《民法通则》中的不足。因此,消费者应认真学习《消费者权益保护法》。并学会以此保护自己。这就需要了解《消费者权益保护法》究竟在哪些方面发展和完善了《民法通则》。概括起来,主要是两个方面。
