引言2009年,厦门法院为践行能动司法,创新社会管理,化解社会矛盾,提出了“创建无讼社区”的工作思路。“无讼社区”创建是一种社会法治化的有益尝试。在经历三年多的实践之后,我们面临着如何为其提供持久的精神动力和广阔视域的问题。任何一项司法实践,无论是从现实可能性还是从价值必要性上来说,都无法脱离当地特定的社会文化而独立展开。在笔者看来,能够为司法实践提供持久精神动力和广阔视域的,正是司法实践所遵循的核心理念及其所根植的社会文化土壤。由于地理位置、语言历史等因素,闽南地区形成了传统而多样的闽南文化。“无讼社区”创建如何得以在闽南地区特殊的社会文化土壤上根深叶茂,需要厘清以下四个问题:一是如何定义“无讼”的内涵与外延;二是闽南社会是否是实现“无讼社区”愿景的理想土壤;三是如何实现闽南文化与“无讼”文化间的融合与共生;四是当前在闽南地区开展“无讼社区”创建应注意些什么。本文以传播学中关于文化传播的“维模”理论为研究工具,对如何在闽南社会土壤上实现“元讼”这一法治理念提出一些看法。
Introduction In 2009, the Xiamen court put forward the working idea of “creating a non-litigious community” in order to practice active justice, innovate social management and resolve social conflicts. “Non-litigation community ” to create is a useful attempt to socialize the rule of law. After more than three years of practice, we face the problem of how to provide them with lasting spiritual power and broad vision. Any judicial practice, whether from the realistic possibility or the necessity of value, can not be separated from the local specific social culture and start independently. In my opinion, it is the core idea followed by judicial practice and the social and cultural soil rooted in it that can provide lasting spiritual motivation and broad vision for judicial practice. Due to geographical location, language history and other factors, Taiwanese has formed a traditional and diverse Taiwanese culture. How to create a “non-litigious community” can be deeply rooted in the special social and cultural soil in southern Fujian. There are four problems to be clarified: First, how to define the connotation and extension of “non-litigation”; secondly, It is the ideal soil for realizing the vision of “no-go community”; thirdly, how to achieve the fusion and symbiosis of Taiwanese culture and “non-litigation” culture; fourthly, the current “non-litigation community” should be established in southern Fujian Pay attention to what. Based on the theory of “dimension mode ” about the spread of culture in communication studies, this article puts forward some views on how to realize the concept of “lawsuit ” on the soil of Minnan society.
