酷刑的非法化是人类文明进化的重要展示,也是人权保障不断提升的重要体现。1984年联合国通过的《禁止酷刑和其他残忍不人道或有辱人格的待遇或处罚公约》是第一个针对酷刑和其他残忍、不人道或有辱人格待遇或处罚的预防和惩治作出具体规定的专门性国际公约。本文介绍了该公约的起草背景、基本框架和主要内容,并结合我国提交的缔约国报告以及委员会结论性意见,考察中国履行义务的情况。
The illegalization of torture is an important manifestation of the evolution of human civilization and an important manifestation of the continuous improvement of human rights protection. The Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment adopted at the United Nations in 1984 was the first to have specific provisions on the prevention and punishment of torture and other cruel, inhuman or degrading treatment or punishment International Convention. This paper introduces the drafting background, the basic framework and the main contents of the Convention, and examines the fulfillment of China’s obligations in light of the reports submitted by China and the concluding observations of the Committee.
