通过分析当事人“被精神病”的原因及医院在强制收治疑似精神病人中可能面临的伦理及法律问题,提出了解决问题的思路:立法确立非危害性疑似精神病人送治的自愿性原则、建立疑似精神病人非自愿住院的第三方鉴定机制以及对具有社会危害性的精神病人实施免费强制治疗。
