一、韩国法概况韩国的传统法律制度源于中国法。中国古代的魏、晋、唐代的法律制度对韩国的传统法律影响极大,唐、宋、元代的法典更是直接被吸收到韩国。但是,韩国随其自身的发展,十九世纪开始了较为彻底的法律改革,逐步远离了中国法传统,最终于一八九四年通过吸收西方法律原则,建立起了全新的现代西方法制。特别是韩国在1910年至1945年受日本的殖民统治,更加速了韩国放弃固有的法律传统的步伐,只在家事法的个别领域仍然保有韩国特色,
First, the Korean Law Overview Korea’s traditional legal system from the Chinese law. In ancient China, the legal systems of the Wei, Jin and Tang dynasties greatly influenced the traditional laws of South Korea. The codes of the Tang, Song and Yuan dynasties were directly absorbed into South Korea. However, with its own development, South Korea started a relatively complete legal reform in the nineteenth century and gradually moved away from the tradition of Chinese law. It eventually established a new modern Western legal system by absorbing the principles of western law in 1894. In particular, South Korea’s colonial rule by Japan from 1910 to 1945 accelerated even more the pace of South Korea’s abandonment of the inherent legal tradition.
